The Challenge of Safeguards in the WTO provides a comprehensive overview of the safeguard mechanism in the multilateral trading system. It explains at length its historical and conceptual foundations and elaborates on the various requirements for the imposition of safeguards and the conduct of safeguard investigations. The author draws on his practical experience in order to analyse WTO case law as developed by WTO panels and the Appellate Body and to provide practical suggestions for the resolution of various complex issues which have arisen in practice. He also considers the challenges faced by companies involved in this type of case.

"In CARICOM: Policy Options for International Engagement, the contributors bring a wealth of experience and knowledge in putting forward the critical questions policymakers must consider and answer, in charting the course and laying the framework for this coordinated structure and foreign policy plan. Divided into four sections, the volume firstly presents the perspectives that corroborate the need for collective action. The second section focuses on the emerging powers and the need for South to South Cooperation while the third section discusses the external trade negotiations and the impact of the loss of EU preferences and subsidies; the EPA and trade negotiations in the WTO; and the new CARICOM-US trade relations. In the fourth and final section, the volume is rounded out by an examination of the kind of cooperation that is needed first at the regional level to sustain economic development. The need for harmonisation of fisheries policies and the prevention of maritime degradation; the preservation of the environment and the need to reverse the effects of climate change; the need for a cohesive regional security policy and a viable air transportation industry as well as the legal framework to implement multilateral treaties are all examined as imperative to CARICOM's development of a coordinated regional foreign policy plan. A deep and unresolved tension exists within American trade politics between the nation’s promotion of an open world trading system and the operations of its democratic domestic political regime. Whereas most scholarly attention has focused on how domestic politics has interfered with the United States’ global economic leadership, Orin Kirshner offers here an analysis of the ways in which U.S. leadership in the arena of global trade has affected American democracy and the domestic political regime. By participating in multilateral trade agreements, the U.S. Congress has transferred its trade policymaking authority to the president and, through international trade negotiations, from the American state to the GATT/WTO regime. This reorganization of policymaking authority has resulted in the "triumph of globalism," and fundamentally alters the citizen-state relationship assumed in democratic theory. Kirshner illustrates this process through four case studies: The Reciprocal Trade Agreements Act of 1945, The Trade Expansion Act of 1962, The Trade Act of 1974, The Omnibus Trade and Competitiveness Act of 1988, and further examines the impact of the Uruguay Round Agreements Act of 1994 on the political and institutional structure of American trade politics up to the current period. American Trade Politics and the Triumph of Globalism makes a significant contribution to the study of both international trade and domestic American politics. This is essential reading for students and scholars of trade policy, international political economy, American politics, and democratic theory.

The liberalization of the Indian economy opened the market to foreign players, creating the need for legislation to regulate the competitive environment and prevent anti-competitive practices of undertakings that would have an impact on markets. Thus, the Competition Act, 2002 was enacted, repealing the erstwhile Monopolies and Restrictive Trade Practices Act, 1969, which had become archaic and did not suit the present needs. “Conceptual Foundations of Competition Law in India” is a succinct text on the Competition Act, 2002. It encapsulates the legal provisions pertaining to cartels, abuse of dominance and combination regulation along with relevant case law in India. It provides a comparative analysis of competition law or anti-trust law in various jurisdictions, including the U.S. and the E.U. This book is a ready reckoner for corporate lawyers, students as well member of the business community in whose interest the law has been enacted.

Political and Economic Foundations in Global Studies provides an innovative introductory examination of the global forces shaping the world today, seen through political and economic lenses. Along with its companion, Social and Cultural Foundations in Global Studies, the book exposes students to the historical contours of, and the key concepts and processes that underlie, the interconnections among individuals, societies, organizations, and governments. As in the rest of Routledge’s Global Studies series, the Foundations books employ a two-part strategy: conceptual underpinnings explored in the first part are enlivened by case studies in the second. Special features magnify the utility of the text: • Text boxes are employed to expand and emphasize specific material: they are used to open up the coverage to related topics or to call attention to especially critical material, such as historical milestones or key vocabulary. • Resource boxes offer links that point readers to sources—mostly online—on the topics discussed and establish a rich archive of additional material for readers to draw on. • At the same time, back-of-chapter References and Further Research lists help students to trace the material used by authors or to follow more general leads relating to the topics covered in the chapters. • Images highlight specific details of the case studies, helping to bring the subjects alive.

As highlighted by Pascal Lamy, the former head of the WTO, world trade traditionally involves state-to-state contracts and is based on an anachronistic 'monolocation' production/trade model. It therefore struggles to handle new patterns of trade such as global value chains, which are based on a 'multilocation' model. Although it continues to provide world trade on a general level with a powerful heuristic, the traditional 'rationalist' approach inevitably leaves certain descriptive and normative blind spots. Descriptively, it fails to explain important ideational factors, such as culture and norms, which can effectively guide the behaviour of trading nations with or without material factors such as interests and utilities. Normatively, the innate positivism of the traditional model makes it oblivious to the moral imperatives of the current world trading system, such as development. This book emphatically redresses these blind spots by reconstructing the WTO as a world trade community from a social perspective.

This book examines the impact of international trade rules on the promotion and protection of human rights, and explains why human rights are an important mechanism for assessing the social justice impact of the international trading system. The core of the book is an in depth analysis of the various ways in which international trade law rules impact upon human rights protection and promotion, emphasising the significance of the jurisdictional context in which the human rights issues arise: coercive measures that are taken by one country to protect and promote human rights in another country are distinguished from measures taken by a country to protect and promote the human rights of its own population. The author contends that international trade law rules have utilised certain ad hoc mechanisms to deal with particularly pressing human rights concerns in the trade context, but also argues that these mechanisms do not provide systemic solutions to the inter-linkages between the two legal systems. The author therefore examines mechanisms by which human rights arguments could be more systematically raised and adjudicated upon in WTO dispute settlement proceedings, highlighting future opportunities and difficulties. He concludes by considering broader systemic issues outside the dispute settlement process that need to be addressed if trade law rules are to successfully protect and promote human rights.

In this book Jeffrey A. Barrett provides an introduction to the history and conceptual foundations of quantum mechanics. He begins with a description of classical mechanics and a discussion of the quantum phenomena that radically undermine our common-sense classical intuitions about how the physical world works. He then considers the physical and conceptual arguments that led to the standard von Neumann-Dirac formulation of quantum mechanics and how the standard theory explains quantum phenomena. This includes a discussion of how the theory's two dynamical laws work with the standard interpretation of states to explain determinate measurement records, quantum statistics, interference effects, entanglement, decoherence, and quantum nonlocality. A careful understanding of how the standard theory works ultimately leads to the quantum measurement problem. Barrett considers how this problem threatens the logical consistency of the standard theory and then turns to a discussion of the main proposals for resolving it. This includes collapse formulations of quantum mechanics, the various many-worlds theories, and Bohmian mechanics. In discussing alternative formulations he pays particular attention to the explanatory role played by each theory's empirical ontology and associated metaphysical commitments, and the conceptual trade-offs between theoretical options. The book is well-suited to those interested in physics and the history and philosophy of quantum mechanics.

Contains updated materials on the war on terrorism, including materials relating to targeted killing, electronic surveillance, and the use of military commissions. Takes account of recent lower court decisions, such as the Third Circuit's decision in United States v. Bond (concerning the scope of the treaty power), and the Fourth Circuit's decision in Yousuf v. Samantar (concerning foreign official immunity and deference to the Executive Branch). Considers the domestic and international law issues associated with U.S. efforts to combat piracy and try pirates in U.S. courts. Excerpts and analyzes the Supreme Court's latest decision concerning the political question doctrine Zivotofsky v. Clinton
